    5. Registrations with this Website

    You can register for specific parts of our website to use additional functions.     6. Newsletter

    General Information

    On some of our websites, you can subscribe to a newsletter, which provides you with updates on the activities of the proALPHA Group, current information about our services, special offers, actions, and events. The content of the individual newsletter is described shortly in the context of the subscription. The legal basis for the subscription to the newsletter is your consent according to Art. 6 Par. 1 lit. a GDPR in conjunction with Section 7 Par. 2 No. 3 of the German UWG or the legal permission according to Section 7 Para. 3 of the German UWG.

    For the subscription to our newsletters, we use the so-called double opt-in procedure. This means, that we will send you an e-mail to the e-mail address you have specified for the subscription, in which we ask you to confirm that you wish to receive the newsletter. If you do not confirm your subscription, your information will be automatically deleted after 3 days.

    We use the obtained information to address you personally. After your confirmation, we will save your e-mail address for the purpose of sending you the newsletter until further notice. Furthermore, we store your IP address at the time of your subscription, the time of the subscription, and the confirmation up to three years after the subscription (limitation period). The purpose of this is to be able to prove your subscription in case of doubt and, if necessary, to clarify a possible misuse of your personal data. The legal basis for the logging of the subscription is our legitimate interest according to Art. 6 Para. 1 lit. f GDPR with the proof of a given consent, see also Art. 7 Para. 1 GDPR.

    Newsletter Tracking

    Please note that we analyze your user actions with the subscription of the newsletter to determine whether and when the newsletter is opened. For this analysis, the e-mails contain so-called web beacons or tracking pixels, which are stored on our server and loaded when the newsletter is opened. Thus, technical information like the browser type, time of the opening, and IP address are transmitted. For the analyses, we link the specified data and the web beacons with your e-mail address and an individual ID. Links within the newsletter also contain this ID, allowing us to analyze your click behavior.

    We create a user profile from the collected data in order to provide you with a newsletter tailored to your individual interests. We register when you read our newsletters, which links you click, and hence conclude your personal interests. We then link these data with your actions on our website. The legal basis for this data processing is your consent, Art. 6 Par. 1 lit. a GDPR.

    You can revoke your consent at any time with effect for the future. When you revoke your consent, this applies to the entire newsletter, since you cannot only revoke the tracking due to technical reasons. To do so, click the unsubscribe link provided in every e-mail.

    Such tracking is also not possible if you have disabled the display of images in your e-mail program by default. In this case, the newsletter is not displayed completely and you might not be able to use all functions. If you manually enable the display of images, the tracking specified above is performed. The information from the tracking is stored as long as you receive the newsletter. When you unsubscribe, the data are used anonymously and only for statistical purposes. We will store the data you shared with us to receive the newsletter until you unsubscribe from the newsletter; they will be deleted afterwards. Data we stored for other purposes remain unaffected.

     

    7. Applications

    You can apply online through the application portal of the proALPHA Group at https://jobs.proalpha.com/job-offers.html. Your online application will be forwarded directly to Human Resources through an encrypted connection and treated confidentially of course.
    If you still apply via e-mail, please note that it is not safe to send unencrypted e-mails or e-mail attachments. Your information is used for processing your application and the decision to establish an employment relationship. The legal basis for this is Section 26 Para. 1 in conjunction with Para. 8 Sentence 2 of the German Federal Data Protection Act. Furthermore, we may process your personal data insofar as this may be necessary to defend against legal claims asserted against us in the application process. The legal basis for this is Art. 6 Par. 1 lit. f GDPR. The specified purposes also include the legitimate interest in the processing.
    If your application results in an employment relationship between you and us, we may process the personal data already received from you for the purpose of the employment relationship in accordance with Section 26 Par. 1 of the German Federal Data Protection Act, if this is necessary for the performance or termination of the employment relationship, or the exercise or fulfillment of rights and obligations regarding the representation of interests resulting from a law, collective agreement, works agreement or service agreement.
    Your application data are not processed in any other way than specified. Your personal data will be deleted immediately after a maximum of 6 months, unless the deletion is in conflict with other legitimate interests on our side or you have given us your express consent for a longer retention of your data. Other legitimate interest in this sense is, for example, a burden of proof in proceedings under the Allgemeines Gleichbehandlungsgesetz (AGG, General Act on Equal Treatment).

    We do not transmit your data to third parties, unless we are legally obliged to do so, or the transmission of data is necessary for the execution of the contractual relationship, or you have given your prior express consent to the transmission of your data.

    The personal data we collect are deleted within the legal retention periods or if the processing purpose becomes void.

    There is no automated decision-making including profiling according to Art. 22 GDPR.

    You have the right to information, correction, deletion, and limitation of the processing, objection to the processing, and data portability. If you have given your consent to the processing, you are entitled to revoke it with effect for the future.

    Pursuant to Art. 21 Para. 1 GDPR, you have the right to object to the processing of your personal data on the basis of Art. 6 Para. 1 lit. e GDPR (data processing in the public interest) or Art. 6 Para. 1 lit. f GDPR (data processing to safeguard a legitimate interest) at any time for reasons arising from your particular situation; this also applies to profiling based on this provision. If you lodge an objection, we will no longer process your personal data, unless we demonstrate compelling legitimate grounds for the processing that override your interests, rights and freedoms, or if the processing serves the establishment, exercise or defense of legal claims.

    11.3. Rights in Direct Marketing

    If we process your personal data for direct marketing purposes, you have the right pursuant to Art. 21 Para. 2 GDPR to object at any time to the processing of your personal data for the purpose of such advertising; this also applies to profiling insofar as it is associated with such direct marketing. If you object to the processing of your personal data for the purposes of direct marketing, we will no longer process your personal data for these purposes.

    11.4. Right to Appeal to a Supervisory Authority

    You have the right to lodge an objection with the competent supervisory authority for data protection about our processing of your personal data.

    If you get in contact with us via e-mail or contact form, we store the data you provided (e.g., your e-mail address or your first and last name) in order to answer your questions.
